3. ELIGIBILITY AND ACCOUNT REGISTRATION

4. SUBSCRIPTION PLANS, PAYMENTS AND REFUNDS

4.1. Access to LawFinder's full features may require a paid subscription. Subscription fees, billing intervals, and renewal terms are set out on the Website or within your subscription plan.

4.2. Payments are processed through secure third-party payment gateways (e.g., PayFast, PayPal, or similar) and are subject to their respective terms of service.

4.3. All prices are in South African Rand (ZAR) and include VAT unless stated otherwise.

4.4. Subscriptions automatically renew unless canceled before the renewal date. You may cancel at any time via your user dashboard; however, no refunds are provided for partial subscription periods or unused access.

5. USE OF THE WEBSITE AND ACCEPTABLE CONDUCT

  • Upload or transmit any harmful code, malware, or attempt to gain unauthorized access;
  • Use automated tools (bots, scrapers) to extract data;
  • Publish defamatory, unlawful, or infringing material;
  • Misrepresent yourself as affiliated with LawFinder or its personnel.

5.3. LawFinder reserves the right to monitor platform activity and remove or restrict access where misuse is detected.

6. INTELLECTUAL PROPERTY RIGHTS

6.1. All materials, content, databases, AI outputs, visual designs, code, trademarks, and text appearing on or generated by the Website are the exclusive property of LawFinder (Pty) Ltd or its licensors.

6.2. Users are granted a limited, revocable, non-transferable, non-exclusive license to access and use LawFinder's materials for personal, educational, and non-commercial purposes only.

9.2. In any event, LawFinder's aggregate liability to you shall not exceed the total subscription fees paid by you in the preceding 12 months.

10. INDEMNITY

11. TERMINATION

12.1. These Terms are governed by the laws of the Republic of South Africa, without regard to conflict-of-law principles.

12.2. Any disputes or claims shall first be resolved through good-faith negotiation. If unresolved, disputes shall be referred to mediation or arbitration under the rules of the Arbitration Foundation of Southern Africa (AFSA), seated in Johannesburg, Gauteng.

12.3. If litigation is pursued, the High Court of South Africa (Gauteng Division, Pretoria) shall have exclusive jurisdiction.

13. CONSUMER RIGHTS UNDER THE CPA

13.1. Nothing in these Terms limits your statutory rights under the Consumer Protection Act 68 of 2008.

13.2. Where the CPA applies, any provision inconsistent with the CPA will be construed to give effect to the consumer's lawful rights.

14. MODIFICATION OF TERMS

14.1. LawFinder reserves the right to update or modify these Terms at any time. Revised Terms will be posted on the Website with an updated revision date.

14.2. Continued use of the Service after publication of revised Terms constitutes your acceptance of the changes.

15. SEVERABILITY AND ENTIRE AGREEMENT

15.1. If any provision of these Terms is held invalid or unenforceable, it shall not affect the remaining provisions, which shall remain in full force and effect.

15.2. These Terms, together with the Privacy Policy and any additional guidelines or notices published by LawFinder, constitute the entire agreement between you and LawFinder (Pty) Ltd.
